Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Our commitment to your privacy

Caring and Wellness Hospice Care, Inc. (“we,” “us,” or “our”) is required by law to maintain the privacy of your protected health information (“PHI”), to give you this notice of our legal duties and privacy practices, and to follow the terms of the notice currently in effect. We will notify you following a breach of unsecured PHI.

How we may use and disclose your health information

Treatment

We use and share your PHI to provide, coordinate, and manage your hospice care, for example with our physicians, nurses, aides, social workers, chaplains, pharmacy, and equipment providers, and with your attending physician and other providers involved in your care.

Payment

We use and share your PHI to obtain payment for services, for example to verify eligibility and bill Medicare, Medi-Cal, or your health plan.

Health care operations

We use and share your PHI to run our agency and ensure quality of care, for example quality assessment, staff training, accreditation, licensing, and compliance activities.

Other uses and disclosures permitted or required by law

  • To family members, friends, or others involved in your care or payment for your care, unless you object
  • For public health activities, health oversight, and as required by law
  • To report abuse, neglect, or domestic violence as required by law
  • For judicial and administrative proceedings, and to law enforcement as permitted by law
  • To coroners, medical examiners, and funeral directors
  • To avert a serious threat to health or safety
  • For workers’ compensation, and for specialized government functions
  • For research, under strict conditions
  • To business associates who perform services for us and have agreed to protect your information
  • To remind you of appointments and to tell you about services that may be of interest to you

Uses and disclosures that require your written authorization

Most uses and disclosures of psychotherapy notes, uses and disclosures for marketing purposes, and disclosures that constitute a sale of PHI require your written authorization. Other uses and disclosures not described in this notice will be made only with your written authorization, which you may revoke at any time in writing.

Your rights

  • Get a copy of your health record, usually within 30 days of your written request. We may charge a reasonable, cost-based fee.
  • Ask us to correct your health record if you believe it is incorrect or incomplete. We may say no, but we will tell you why in writing.
  • Request confidential communications, for example to contact you only at a certain phone number or address.
  • Ask us to limit what we use or share. We are not required to agree, except that we must agree not to share information with your health plan for services you paid for in full out of pocket.
  • Get a list of those with whom we have shared your information (an accounting of disclosures) for the six years prior to your request, excluding disclosures for treatment, payment, and operations and certain other disclosures.
  • Get a copy of this notice at any time, even if you agreed to receive it electronically.
  • Choose someone to act for you, such as a medical power of attorney or legal guardian.
  • File a complaint if you feel your rights are violated. You will not be retaliated against for filing a complaint.

You may also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights by sending a letter to 200 Independence Avenue S.W., Washington, D.C. 20201, calling 1-877-696-6775, or visiting www.hhs.gov/ocr/privacy/hipaa/complaints/.

Changes to this notice

We reserve the right to change this notice and to make the revised notice effective for PHI we already have as well as any information we receive in the future. The current notice is posted in our office and on our website, and a copy is available on request.
